Liability: A Legal Explanation

A frequently asked question is "What is legal liability?"

When an accident claim is made, the personal injury solicitor must prove that the person against whom the case is directed is legally responsible for the accident and the injuries you have sustained.

Injury compensation cannot be claimed for a "pure accident". For a personal injury claim to succeed, we must be able to show that someone else was to blame for the accident. Establishing blame is known as "liability".

In personal injury cases blame normally arises because somebody did something they should not have done, or because they failed to do something they should have done.

Assessing liability in any given accident situation requires expert legal knowledge and considerable experience of personal injury compensation cases in all but the most straightforward circumstances.

Where a personal injury claim is rejected by the other side, accident solicitors talk in terms of liability being ‘disputed’. If the parties cannot agree on whose fault the accident was then the case may have to progress to a court hearing, where a judge will decide who is liable for the accident and whether compensation should be paid for the claimant's injuries.

If liability is established, the injury claim will succeed and compensation will be awarded. If liability is not proved the claim will be lost and no compensation for the injuries will be made.
