A meat slicer and contributory negligence
Our client, Mrs H, was employed by a meat processing/packing company when she was asked to operate a meat slicing machine.
Although Mrs H had received some initial training this was not complete. Unfortunately the meat slicing machine was not in good repair as the spring loaded arm would not stay in place.
Whilst using the machine, Mrs H suffered a laceration to her right index finger. This required hospital treatment.
Mrs H had failed to follow all of the training she had received and did not wait for the blade to fully stop before trying to reset the machine. As a result the Defendant alleged that Mrs H was to blame for her accident.
We did not accept this but Mrs H did accept that she was partly to blame as she did not follow her training.. Contributory negligence was agreed at 20% and after medical evidence was obtained Mrs H received £3,400 compensation for her injuries.
